Agreement to these terms
This website, https://sugamamabrittle.shop (the “Site”), is operated by Sugamama’s Homemade Brittle in Akron, Ohio (“we,” “us,” “our”). By using the Site you agree to these Terms of Use, our Privacy Policy, and our Disclaimer and Allergen Notice. If you do not agree, please do not use the Site.
About the Site
We are a seasonal business. We sell our brittle in person at holiday craft shows and markets in November and December, and we plan to take online orders for shipping. The Site shows our products, our show schedule, and how to contact us. When online ordering is closed, products cannot be purchased through the Site.
Orders, payment, shipping, and returns
When online ordering is available on the Site, the following applies.
- Orders. Our brittle is made by hand in limited seasonal batches. Placing an order is an offer to buy. We may limit quantities, decline an order, or cancel an order if an item is unavailable, and we will refund any payment we have already taken for an order we cancel.
- Prices and taxes. Prices are in U.S. dollars and may change. Any applicable sales tax and shipping charges are shown at checkout before you pay.
- Payment. Payments are handled by secure third-party payment providers such as Stripe and PayPal. We do not see or store your full card number.
- Shipping. We ship to the addresses available at checkout. Please check that your shipping address is complete and correct, because we cannot refund or replace an order that is delayed or lost because of an address error. Carrier delivery times are estimates, not guarantees.
- Heat and weather. Brittle can soften or stick in heat and humidity. Please bring packages inside soon after delivery.
- No returns. Because brittle is a food product, all sales are final and we do not accept returns or exchanges. If your order arrives damaged or is not what you ordered, contact us as soon as possible at [email protected] with your name, your order details, and clear photos of the box and the brittle, and we will work with you on a replacement or refund. Brittle is fragile, so some breakage into smaller pieces in transit is normal.
Events and show information
Dates, times, and locations on our Events page are provided for your convenience. Event organizers can change schedules, hours, or rules, and weather or venue conditions can affect shows. Please check with the event organizer before you travel.
Products and allergens
We make peanut, cashew, almond, and pecan brittle by hand. Our products contain peanuts or tree nuts and may come into contact with other nuts and common food allergens. Please read our Disclaimer and Allergen Notice and contact us with any allergy or ingredient questions before you buy or eat our products.
Content and intellectual property
The Sugamama’s name, logo, photographs, text, and design on the Site belong to us or are used with permission. Please do not copy, republish, or use them for commercial purposes without our written permission.
Acceptable use
Please do not use the Site for anything unlawful, try to bypass its security, send spam or false messages through our forms, or interfere with how the Site works.
Disclaimers and limits of liability
The Site and its content are provided “as is” and “as available,” without warranties of any kind. To the fullest extent the law allows, Sugamama’s Homemade Brittle and its owners are not liable for indirect, incidental, or consequential damages arising from your use of the Site. Nothing in these terms limits any rights you have that cannot be limited by law.
Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules.
Changes
We may update these terms from time to time. The date at the top shows when they were last changed. Continued use of the Site means you accept the updated terms.
